These Terms & Conditions govern your use of the MyPholyo website at mypholyo.com, the MyPholyo web application at app.mypholyo.com, and our iOS and Android applications (together, the "Services"). The Services are operated by The Portfolio Method Ltd, trading as MyPholyo ("we", "us", "our"). By accessing or using the Services, you agree to these Terms. Please read them carefully.

Our services

MyPholyo provides portfolio-career tools and services, including the MyPholyo Mapper, personalised AI-generated reports and insights, educational content, and subscription-based features available through our web and mobile applications. Our Services are intended for adults aged 18 and over who are building, developing or managing portfolio careers.

The MyPholyo Mapper

The MyPholyo Mapper (formerly the Portfolio Audit) is an assessment tool designed to help you understand your income streams, energy, pricing, visibility and other aspects of your portfolio career. Reports and insights may be generated using artificial intelligence and are intended as a starting point for reflection and planning. They do not constitute legal, financial, tax, medical or other regulated professional advice. You remain responsible for decisions you make using the information provided.

Accounts

Some parts of the Services require an account. You must provide accurate information where required, keep your login details secure, and tell us promptly if you believe your account has been compromised. You are responsible for activity carried out through your account. You must not share your account access with another person unless we expressly permit this.

Paid services, subscriptions and payments

Some MyPholyo features require a paid subscription or other purchase. The price, billing period, any trial or promotional period, whether a subscription renews automatically, and any applicable VAT or taxes will be shown to you before you complete the purchase.

• Depending on where you purchase, payment may be processed by Stripe or by the relevant app-store provider, such as Apple's App Store or Google Play. The payment provider's terms may also apply.
• If a subscription is described as auto-renewing, it will continue for the stated billing period until you cancel it. The renewal price and frequency will be shown before purchase and in any notices required by law.
• You can cancel an auto-renewing subscription using the cancellation method available for the channel through which you purchased it, for example your MyPholyo account settings or the relevant app-store subscription settings.
• Cancelling stops future renewals. Unless applicable law or the relevant payment provider requires otherwise, you will normally retain access until the end of the period you have already paid for.
• If we offer a free or reduced-price trial that converts into a paid subscription, the length of the trial, the price after the trial and how to cancel will be shown before you start it.
• We may change our prices. Where a change affects an existing auto-renewing subscription, we will give any notice required by law or the relevant payment provider before the new price applies.

Nothing in these Terms affects your statutory consumer rights. Where you have a legal cooling-off, cancellation or refund right, we will honour it. Purchases made through an app store may also be subject to that app store's refund and cancellation process.

Mobile apps and licence terms

Your use of the MyPholyo iOS and Android applications is also subject to our End User Licence Agreement (EULA) and any applicable terms of the app store from which you obtained the app.

Intellectual property

The MyPholyo website, applications, software, MyPholyo Mapper framework and methodology, written content, branding, reports, features and other intellectual property are owned by or licensed to The Portfolio Method Ltd. You may not reproduce, distribute, sell, sublicense or use our content, software, methodology or outputs for commercial purposes without our prior written consent, except where applicable law expressly permits this.

Your own information remains yours. Reports and personalised outputs generated for you through MyPholyo may be used by you for your own personal and professional purposes.

Acceptable use

When using the Services, you agree not to:

• provide false or misleading information where that could affect the operation, security or integrity of the Services;
• reverse engineer, decompile, disassemble or attempt to discover or reproduce our source code, underlying systems, models or methodology except where applicable law expressly permits this;
• use MyPholyo to create or develop a competing product or commercially reproduce our frameworks, methodologies or outputs;
• interfere with, disrupt or damage the Services or attempt to gain unauthorised access to our systems or another user's account;
• bypass security measures or usage restrictions;
• use the Services in any unlawful, fraudulent, abusive or harmful way; or
• use the Services in breach of applicable third-party or app-store terms.

AI-generated content

MyPholyo uses artificial intelligence to generate certain reports, insights, recommendations and other personalised content. AI-generated information may be incomplete, inaccurate or unsuitable for your individual circumstances. You should use your own judgement and obtain advice from a suitably qualified professional where appropriate. You remain responsible for decisions you make based on information provided through MyPholyo.

Our collection and use of personal information is explained in our Privacy Policy. Our use of cookies and similar technologies on the website is explained in our Cookie Policy.

Third-party services

The Services may rely on or link to third-party services, including payment providers, identity providers, app stores and technology providers. Those third parties may have their own terms and privacy policies. We are not responsible for third-party services that are outside our control.

Availability and changes to the Services

We may update, improve, change, suspend or discontinue features of MyPholyo from time to time. We do not guarantee that the Services will always be available, uninterrupted or error-free. We may require you to install updates to continue using certain features or to maintain security and compatibility.

Suspension and termination

We may suspend or restrict your access if we reasonably believe you have materially breached these Terms, the Services are being misused, or action is necessary to protect users, MyPholyo or our systems. Where appropriate, we will give you notice and a reasonable opportunity to address the issue. You may stop using the Services at any time, subject to the cancellation terms that apply to any paid subscription.

Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. While we take care to provide a reliable service, we do not guarantee that the Services will be uninterrupted or error-free, or that any report, insight or outcome will meet your particular requirements. Nothing in these Terms excludes any right or remedy that cannot lawfully be excluded.

Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the paragraph above and to the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Services. Where it is lawful to limit our total liability, our total liability to you in connection with the Services will not exceed the amount you paid to us for the Services in the 12 months preceding the event giving rise to the claim.

Governing law

These Terms are governed by the laws of England and Wales. If you are a consumer, this does not deprive you of any mandatory rights or protections that apply under the law of the country in which you live, and you may have the right to bring proceedings in your local courts where applicable law provides this.

Changes to these Terms

We may update these Terms as MyPholyo evolves, our commercial arrangements change, or legal requirements change. We will update the date at the top of this page and, where a change is significant or the law requires it, provide appropriate notice. If a material change affects an ongoing paid subscription, we will provide any cancellation or other rights required by applicable law.
